The Dividing Fences Act 1991 (NSW) provides that an adjoining owner is liable to equally contribute to the carrying out of fencing work for the provision of a sufficient dividing fence between land. This simply means that, as a landowner, you must equally contribute (pay) to the cost of erecting a fence on the boundary of your property. Disputes usually arise when it comes to agreeing on the type of fence, the colour or the cost of the proposed fence.
