Every person has the right to protect their property from intruders: one common practice is to install surveillance cameras. Not only does this alert the home or business owner to a potential break in and provide much needed evidence to the authorities, this can also reduce your insurance premium.

However, a poorly placed security surveillance camera can actually invade the privacy of your neighbour. Under s 8 of the Surveillance Devices Act 2007 (NSW), it is illegal for a person to install a CCTV camera on someone else’s property without the consent of that person. However, there is nothing in The Act that prevents a person from installing a CCTV camera on a property that they own or with the consent of the owner of that property and recording activities on a neighbouring property. The Crimes (Domestic and Personal Violence) Act 2007 (NSW) s13, makes it an offence for a person to stalk another person with the intention of causing the other person fear, physical or mental harm. Stalking includes watching a person’s place of residence.
